Fight for the Medical Device Safety Act

The Supreme Court's decision in Riegel v. Medtronic had the effect of giving complete immunity to medical device manufacturers. Now people injured through no fault of their own can't hold the manufacturer accountable. Many are forced onto Medicare or Medicaid and it is estimated that taxpayers will be on the hook for over $1 billion to cover the their healthcare. This is unfair on many levels. Tell Congress to stop stalling and fix this by passing HR 1346/S 540, the Medical Device Safety Act.

How many people will be tortured or killed by faulty medical devices if manufacturers have no accountability?

I am writing to request that you take immediate action to pass HR 1346/S 540, the Medical Device Safety Act.  This bill has languished in committee as thousands of patients continue to be injured or killed by faulty medical devices.  Will Congress do nothing?  Or stand up for real people and restore accountability to the medical device industry?

Currently, patients injured or killed by faulty implanted medical devices have no recourse against the manufacturer, and many must turn to Medicare for payment of their medical bills – bills that should be paid by the manufacturer.  According to a recent report by Professor Dennis Tolley, this cost to the taxpayers will be over $1 billion for just one type of device.  This is completely unfair at a time when we need to be cutting costs and reigning in corporate greed.

The current state of the economy fully illustrates that corporations must have an incentive to create a safe product, or they will put their profits over people.  Without the ability to hold medical device manufacturers accountable, they have no reason to maintain product safety.  Please don’t put patients at risk a minute longer.  Pass HR 1346/S 540, the Medical Device Safety Act.
